However if the car wasn't a rental and the owner didn't have insurance you are stuck settling it out of court, or small claims court after his hit and run. Id come up with a dollar amount and settle it out of court. call him and say its 1000$ in damages and meet me with cash or ill have the cops called. But the right thing to do is call the cops and file a report. However i was just involved in an accident where the other driver (while at fault) did not have insurance and we were stuck with the wrecked vehicle and settled out of court.
